Terms & Conditions
1. Terms and Conditions
- These terms and conditions apply if you make a booking to attend a Retreat offered by Ocean Earth Retreats Pty Ltd ACN 681 645 876.
- By booking into a Retreat you:
(i) acknowledge that you have read and fully understood these terms and conditions and the Waiver and Release of Liability Agreement; and
(ii) agree to accept and adhere to these terms and conditions and sign the Waiver and Release of Liability Agreement.
- These terms and conditions supersede any information or statements you may have received from Ocean Earth Retreats.
2. Definitions
- You refers to the guest booking a Retreat offered by Ocean Earth Retreats.
- We, us or our refers to Ocean Earth Retreats.
- Cancel is defined as not attending your scheduled Retreat, including postponing or rescheduling.
- Retreat means a retreat offered and run by Ocean Earth Retreats which includes the Activities, accommodation and meals.
- Activities means all the activities undertaken whilst at the Retreat which include, but are not limited to, yoga, surfing, stand up paddle boarding, snorkelling, ocean swimming and boating.
- Ocean Earth Retreats means Ocean Earth Retreats Pty Ltd ACN 681 645 876.
3. Retreat Payment Policy
- Once we receive a completed Reservation Form, a signed Terms & Conditions Form and a signed Waiver and Release of Liability Agreement from you and we have confirmed availability on your selected Retreat, we will send you a courtesy hold confirmation (Tentative Booking) via email that is valid for 3 days.
- To secure a spot in your selected Retreat, a AU$500.00 non-refundable payment (Deposit) is required within 3 days of the time the reservation is made. If this payment is not made, your Tentative Booking will be automatically released.
- Following receipt of the Deposit, full payment of the remaining balance can be made at any time but no later than as follows:
- 50% of the remaining balance owing paid no later than 6 months prior to the start date of the Retreat; and
- the full remaining balance owing paid no later than 3 months prior to the start date of the Retreat.
If payments are not received as outlined above, we reserve our right to cancel your booking and retain the Deposit.
- If you book 3 months or less before the start date of the Retreat, you must pay in full at the time of booking.
- Payment details will be sent to you in our confirmation email and payment can be made by bank transfer or by credit card (subject to payment of a 1.7% plus $0.30 online payment fee).
- To the fullest extent permitted by law, we make no warranties about the goods or services we supply. Where you have the benefit of guarantees that cannot by law be excluded or varied, our liability for breach of any such guarantee is limited (in our option) to repair or replacement of goods, re-supply of services or payment of the cost of same.
4. Guest Cancellation Policy
- We are a small business with prepaid commitments and, therefore, do not offer refunds for any reason. If you decide to cancel your Retreat booking, part of your payment may be used as credit for another Retreat. Such credit must be used within one year of your original Retreat date.
- Depending on when you cancel your booking, cancellation penalties and credit will apply as follows:
- If you cancel more than 90 days before the start of the Retreat, 80% of the payment may be applied to another Retreat and you will forfeit 20% of the price of the Retreat;
- If you cancel 60 – 89 days before the start of the Retreat, 60% of the payment may be applied to another Retreat and you will forfeit 40% of the price of the Retreat;
- If you cancel 30 – 59 days before the start of the Retreat, 50% of the payment may be applied to another Retreat and you will forfeit 50% of the price of the Retreat; and
- If you cancel 30 days or less before the start of the Retreat, you will forfeit your entire payment.
- You may transfer your credit to another guest with our approval (which approval can be refused if, in our opinion, the proposed guest is not suitable for participating in one of our Retreats).
- Exceptions to our cancellation policy cannot be made for any reason and, therefore, we highly recommend that you take out travel insurance as soon as you have paid the Deposit.
- We do not offer credit or a discount if you arrive to the Retreat late or leave early.
- All cancellations must be in writing via email to retreats@yogaone.com.au .
5. Cancellation by Ocean Earth Retreats Policy
- Whilst we have never cancelled a Retreat to date, if we must cancel a booked Retreat for any reason other than those listed in clause 5 (b), you will be entitled to transfer your full retreat payment to another scheduled Retreat or you may request a full refund of any payments you have made (minus any credit card charges), and such refund will constitute full settlement of any claims or obligations on our part.
- We shall not be held responsible for any failures beyond our control, including but in no way limited to natural disasters, a national / global health issue (such as a pandemic), acts of God, compliance with any law or government order, breakdown of plant or machinery, industrial disputes, closure of Country borders, airport closures, war, accidents, or the failure of third parties, such as suppliers and subcontractors, which result in a delay or cancellation of the Retreat or its services.
- We will not be held responsible for any expenses incurred due to a cancelled Retreat, including airline tickets, lost wages, or other costs related to your trip preparation. It is, therefore, essential to purchase travel insurance as soon as you have paid the Deposit.
- We reserve the right to substitute any instructors or any other personnel of Ocean Earth Retreats should unavoidable circumstances arise whereby they are unable to attend the Retreat.
- We also reserve the right to alter the content or itinerary of the Retreat at any time without notice to you due to certain factors, including, but not limited to, the weather, staff and any physical fitness of the guests.
- If you chose not to participate in any of the Activities, we are under no obligation to provide an alternative activity and you will not be entitled to a refund.
6. Travel Requirements
- The Retreat includes 5 nights’ accommodation, the Activities, fast boat return transfers and meals that are specified as included in your booking. The Retreat fees do not include air fares, taxes, insurance, airport transfers, any other travel expenses not included in the specified inclusions or drinks and dinner on the first night.
- Any therapies, additional meals, alcoholic drinks or snacks outside of those specified as included in the Retreat will be charged as extras to the cost of the Retreat. If you fail to settle your account for these extras prior to departing the Retreat, an administration fee equal to 25% of the total unpaid bill will be added to the charge.
- It is solely your responsibility to ensure that you have a valid passport, visa and re-entry permits which meet the requirements of the immigration and other government authorities of the Retreat location. We will not be held responsible, nor will we be able to credit any part of or refund any payments made for a delay or cancellation of your Retreat booking due to your failure to obtain or hold the required travel documentation.
- We will not be held responsible for any loss or damage to property that occurs whilst at the Retreat.
- It is a condition of attending the Retreat that you have a current and comprehensive travel, medical and liability insurance policy (Insurance Policy). The Insurance Policy must cover you for all adventure sport activities, medical emergencies, property damage or theft and trip cancellation. You must provide us with a copy of the Insurance Policy’s Certificate of Currency of Insurance within one week of booking or 90 days prior to the start date of the Retreat, whichever is the later. You understand and agree that you will be unable to attend the Retreat unless an Insurance Policy is in place. If you fail to obtain the required Insurance Policy within the timeframe required, you will be subject to an automatic cancellation and the policy set out in clause 4 shall apply.
7. Participation Requirements
You understand and acknowledge that you will not be able to book into or attend a Retreat nor participate in the Activities unless you have signed a Waiver and Release of Liability Agreement.
8. Your Health Requirements and Conduct
- It is your responsibility to understand any health requirements and recommended precautions related to your travel to the Retreat.
- We reserve the right to refuse you from participating in a Retreat (or any part thereof) or the Activities if we:
- perceive a significant risk of injury to yourself or others due to your participation;
- perceive that you have a contagious illness or physical condition or illness; or
- determine that your behaviour is disruptive to other guests and the overall Retreat experience.
- You agree to comply with all directions and policies connected to your attendance at the Retreat and participation in the Activities.
- If you engage in inappropriate, illegal, or disruptive behaviour (such as bullying, harassment, discrimination, unlawful actions, or violent or intimidating conduct) towards any person (including but not limited to us, the local community, or other guests and participants), you will be required to leave the Retreat at your own expense, and no refund will be provided.
- You will be liable for the activities that you chose to participate in during any free time at the Retreat and we will not be held responsible for your actions.
9. Media
- We reserve the right to take any photos and recordings during the Retreat and you accept and agree that any photos or recordings may be used by us in our absolute discretion in any manner, including but not limited to, our website, promotional material and advertisements.
- If you do not wish to be photographed or recorded whilst at the Retreat, you must notify us in writing before the start date of the Retreat.
10. Governing Law
These terms and conditions will be governed and construed in accordance with the laws of New South Wales and you irrevocable submit to the non-exclusive jurisdiction of the courts of New South Wales.
